These Terms and Conditions (“Terms”) govern your access to and use of the FemAura mobile application and any related services (the “App”). The App is provided by Femaura Health Private limited (“we”, “us”, “our”).
Please read these Terms carefully. By creating an account or using the App, you agree to be bound by them. If you do not agree, do not use the App. These Terms work together with our [Privacy Policy], which explains how we handle your data.
1. Important health notice — please read first
FemAura is a women’s health and cycle-tracking tool. It helps you log information about your body and gives you estimates and general educational information across period tracking, trying to conceive, pregnancy, and well-being.
FemAura is not a medical device and does not provide medical advice, diagnosis, treatment, or antenatal (pregnancy) care.
Estimates, not facts. Predictions — including your next period, cycle phase, fertile window, ovulation, estimated due date (EDD), and pregnancy week — are calculated from the information you enter. They are shown as ranges wherever we are not certain, and they can be wrong, especially early in use and for irregular cycles, PCOS, or other conditions.
FemAura is not birth control. The App does not prevent pregnancy and does not protect against sexually transmitted infections. Never rely on it, or on any feature within it, as a method of contraception.
FemAura does not confirm or monitor a pregnancy. Estimated due dates and week-by-week content are informational only and are not a substitute for prenatal care. Tools such as the kick counter and contraction timer are self-tracking aids, not medical devices, and must not be used to decide whether or when to seek medical care.
High-risk flags are not diagnoses. Selecting conditions such as PCOS, gestational diabetes, high blood pressure, twins, or previous loss only tailors the information you see. It is not a medical assessment.
Not a substitute for a doctor. Always consult a qualified healthcare provider about any health question or before making a health decision. If you may be pregnant, or have any concerning symptom, contact a healthcare provider.
Not for emergencies. If you think you have a medical emergency, contact your doctor or emergency services immediately.
You use any estimate or information provided by the App at your own risk.
2. Definitions
“Account” — the account you create to use the App.
“Content” — anything you enter into the App, including your name, age, weight, and your period, cycle, fertility, pregnancy, mood, symptom, and well-being information (“Health Data”).
“Path” — the experience you select at setup (Track my period, Trying to conceive, Already pregnant, or Track my well-being).
“Subscription” — a paid plan that unlocks premium features.
3. Eligibility — adults only (18+)
FemAura is for adults only. You must be at least 18 years old to create an account or use the App in any way.
No use by anyone under 18. The App is not directed to, and may not be used by, anyone under the age of 18. There is no under-18 or “teen” mode.
Age confirmation. You confirm at setup that you are 18 or older. Giving false age information is a breach of these Terms.
If we learn a user is under 18. We may refuse, suspend, or terminate access, and we will delete the associated account and data as described in our [Privacy Policy].
4. Your account
You are responsible for the accuracy of the information you provide and for keeping your login details secure.
You are responsible for activity that happens under your Account.
Tell us promptly at [support email] if you think your Account has been used without your permission.
5. Paths and features
FemAura tailors itself to the goal you choose. Each path has its own limits:
a. Track my period. Period and cycle tracking, with predictions shown alongside a sureness level. Where your cycle varies, the App shows an honest range rather than a single date.
b. Trying to conceive. Estimates a fertile window from your logged dates only (calendar-based). It is a planning guide, not a medical fertility assessment, and is not a form of contraception. Where the App suggests speaking to a doctor or specialist (for example, after a long time trying), that is general guidance, not a diagnosis.
c. Already pregnant. Provides an estimated due date shown as a range, week-by-week information, and optional tools (weekly updates, doctor-visit reminders, kick counter, contraction timer). This path is informational only and is not prenatal care or medical monitoring. See the health notice in Section 1.
d. Track my well-being. Lets you track things like mood, sleep, energy, stress, and your own weight trend, optionally linked to your cycle. These are general wellness features, not tools to diagnose or treat any condition (including mental-health or weight-related concerns). The App shows your own trend and does not set targets or an “ideal” weight.
e. Birth-control / pill tracking (where offered). Any pill reminder or birth-control tracking is a convenience feature only. It does not make FemAura a contraceptive and does not prevent pregnancy or infections.
You can change your goal or path later. Changing paths changes what the App shows but does not delete your history.
6. Predictions, estimates, and ranges
FemAura is deliberately honest about uncertainty. You acknowledge that:
predictions (cycle, fertile window, EDD, pregnancy week) are estimates and are shown as a range whenever we are not certain;
accuracy is lower early on, and for irregular cycles or relevant conditions;
the App will never present an estimate as a certainty; and
no prediction should be relied on for medical, contraceptive, or family-planning decisions.
7. Partner sharing
If you invite a partner (for example, by WhatsApp or SMS) to follow your pregnancy or log alongside you:
you are responsible for having that person’s permission to contact them and share information with them;
what you choose to share becomes visible to them; and
their use of the App is governed by these Terms. You can stop sharing at any time in Settings.
8. Your data, privacy, and consent
Your Health Data is sensitive personal information. How we collect, use, store, and protect it is set out in our [Privacy Policy], which forms part of these Terms.
The App asks for your explicit agreement to collect your Health Data during setup, and will not continue without it. You can withdraw consent by deleting your account.
We aim to collect little data, store it securely (including encryption at rest), and keep alerts discreet.
Consistent with the DPDP Act, you can export your data and delete your account from within the App. Deleting your account removes your personal data as described in the Privacy Policy.
9. Your Content
You keep ownership of the Content you enter, including your Health Data.
You grant us a limited licence to store and process your Content solely to operate and improve the App and provide the services to you, as described in the Privacy Policy.
You are responsible for the accuracy of what you log.
10. Subscriptions and payments
Some features may require a paid Subscription. Prices and features are shown in the App at the point of purchase, in your local currency (including Indian rupees) where available.
Subscriptions bought through the Google Play Store or Apple App Store are billed and managed by that platform under its terms. Auto-renewal, cancellation, and refunds are handled through your app-store account.
Except where required by law or stated otherwise, payments are non-refundable.
We may change Subscription prices with reasonable prior notice; changes take effect from your next billing cycle.
11. Notifications
You choose which reminders you receive, and the App respects quiet hours. Notifications are reminders only and are not guaranteed to be delivered or accurate; do not rely on them for time-critical or health-critical decisions.
12. Acceptable use
You agree not to:
use the App unlawfully or in breach of these Terms;
copy, modify, reverse-engineer, or create derivative works of the App, except as permitted by law;
attempt to gain unauthorised access to the App, other accounts, or our systems;
upload malicious code or interfere with the App’s operation; or
use the App to harm or infringe the rights of others, including anyone you invite.
13. Intellectual property
The App — including its software, design, text, graphics, the FemAura name, and logos — is owned by us or our licensors and is protected by law. Except for the limited licence to use the App for your own personal, non-commercial use, no rights are transferred to you.
14. Third-party services
The App relies on and may link to third-party services (for example, app stores, hosting providers, messaging apps used for partner invites, and, in future versions, health platforms such as Apple Health or Health Connect). We are not responsible for third-party services, and your use of them is governed by their own terms.
15. Disclaimers
To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any estimate will be accurate. This is in addition to the health notice in Section 1.
16. Limitation of liability
To the fullest extent permitted by law, we (and our affiliates, officers, and employees) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or relating to your use of (or inability to use) the App — including any reliance on a prediction, fertility or due-date estimate, tracking tool, or reminder.
To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to these Terms or the App is limited to the greater of (a) the amount you paid us in the [12] months before the claim, or (b) [INR amount].
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
17. Indemnification
You agree to indemnify and hold us harmless from claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.
18. Suspension and termination
You may stop using the App and delete your Account at any time from Settings.
We may suspend or end your access if you breach these Terms, or where necessary to protect the App, other users, or to comply with law.
Sections that by their nature should survive termination (including Sections 8, 9, 13, 15, 16, and 17) will continue to apply.
19. Changes to the App and these Terms
We may change or discontinue features of the App.
We may update these Terms from time to time. If we make material changes, we will give reasonable notice (for example, in the App). Continuing to use the App after the changes take effect means you accept the updated Terms.
20. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to any right you have under applicable law, the courts of [Bengaluru, Karnataka] will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App.
21. General
Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
Severability: If any provision is unenforceable, the rest remain in effect.
No waiver: Our failure to enforce a right is not a waiver of it.
Assignment: You may not assign these Terms without our consent; we may assign them to a successor.

FemAura is an adults-only (18+) app that handles sensitive health data, including pregnancy data, under India’s DPDP Act. Have these Terms and the Privacy Policy reviewed by a lawyer qualified in India before launch — with particular attention to how the 18+ restriction is enforced at signup, the health, pregnancy, and contraception disclaimers, partner-data sharing, and the liability cap.
